Over 200,000 Georgia Ballots Called into Question by Amistad Project’s Litigation

On November 25, 2020, the Amistad Project filed a lawsuit contesting the results of the 2020 Presidential Election in Georgia, citing expert opinion that says more than 100,000 votes were improperly counted, while tens of thousands of lawful votes were not counted.

Amistad asked the courts to recognize a pattern of lawlessness and irregularities in Georgia by invalidating the election result and allow the Georgia General Assembly to appoint the state’s presidential Electors.

Georgia has taken some steps to secure election integrity but there is still a lot of work to be done:

·       Hotline for Voter Fraud. Section 4 allows the state AG to set up an election integrity hotline for people to report crimes on.

·       Penalizing Corrupt Election Workers. Section 6 states that the State Board of Elections can suspend a local superintendent for not following the law.

·       Sudden Changes of Election Laws are Prohibited. Section 8 – when emergencies occur, there needs to be proper notice rules required to change a precinct location, use mobile voting centers, etc.

·       Superintendent Cannot Accept Private Funds, but other Entities Can. Section 9 – a superintendent of elections can’t accept private funding for elections.  However, there is nothing to stop local city councils, mayors, or legislative boards from accepting.  The loophole here is too big.

·       Private Grants Can’t Go To Registrar Boards. Section 11 – Bans registrar boards from accepting private grants to fund public elections.

·       Potential Voter. Section 17 – requires the SOS to obtain info on citizens who move in order to clean voter rolls, but doesn’t provide any teeth for enforcement.

·       Limiting Absentee Ballots. Section 25 shortens the amount of time that an absentee ballot can be requested.
